Domestic Violence

Defense Against Domestic Violence Charges in Denver Courts

Domestic Assault • Protective Orders • Violation of Protective Orders

When the police are called to your residence or workplace because of a report of a domestic disturbance, someone is going to get arrested. Even if the police didn't see anything happening. Even if both people were equally responsible for the fight. Someone is going to be removed from the home.

If you were arrested for domestic abuse, your life is going to change. The affect of the charges — and the actions that will follow — depend a great deal on what you do in the next few days.

Take immediate action to get an experienced defense lawyer on your case. Contact me, attorney Mitch Baker, to schedule a free consultation as soon as possible. I have been defending people against domestic violence charges for 30 years. I can explain your options, help you avoid actions that could make your situation worse, and prepare an effective defense.

The Protective Order

In many domestic violence cases, the "victim" will quickly get a temporary protective order (also called an order for protection or a restraining order). It's extremely important that you not violate that order, intentionally or unintentionally, even if you believe it is wrong and unfair. We will have a chance to fight the protective order in court and your actions now can make a difference when we come before the judge. Any threats or harassment can be used against you.

Investigating the Domestic Violence Charges

Sometimes domestic abuse charges are based on an outright lie and are an attempt by one person to get the other person out of the house. Sometimes there is some truth to the charge, but it's not the whole truth and when the whole truth is known, it puts your actions in a different light.

Sometimes the charges are true, but jail time and a criminal record is not necessarily the best way to help a troubled family. There may be alternative sentences the court can impose that are more fair, given the facts of the case — anger counseling, alcohol treatment and probation, for example.

My goal is always to achieve the best possible outcome in your case. That may be getting the case dismissed, negotiating a lesser charge, or getting an alternative sentence. I have handled many spousal abuse cases throughout my years of practice. I understand how the courts view these cases and can provide a strong, aggressive defense.
